Abstract

Economic globalization encourages openness in international trade, requiring Micro, Small, and Medium Enterprises (MSMEs) to enhance their competitiveness in accessing global markets. However, export and import regulations in Indonesia remain complex and have not fully provided affirmative policies for MSMEs. This study aims to analyze the legal framework governing export and import activities of Indonesian MSMEs within the perspective of national law and its relevance to international trade regimes in supporting MSMEs’ access to global markets. This research employs a normative juridical method using statutory, conceptual, and analytical approaches. The findings indicate that existing regulations, including customs, trade, and MSME laws, remain general in nature, fragmented, and heavily administrative, thereby creating structural barriers for MSMEs in international trade activities. Optimization efforts require simplification of export-import procedures, stronger integration with the Trade Facilitation Agreement (TFA), digitalization of customs services, and capacity building for MSMEs. Therefore, legal reform is required to establish a more inclusive and facilitative regulatory framework for MSMEs in global trade.
