Perlindungan Hukum Terhadap Pemegang Sertipikat Elektronik Sebagai Bukti Kepemilikan Hak Atas Tanah (Studi Pada Kantor Pertanahan Kota Palembang)

Abstract

Research titled "Legal Protection for Holders of Electronic Certificates as Evidence of Land Ownership Rights (Study at the Land Office of Palembang City)." The issues being researched include the factors that hinder the implementation of electronic certificates in land registration at the Palembang City Land Office, the examination of electronic certificates as proof of land ownership rights in court proceedings at the Palembang City Land Office, the responsibilities and steps taken by the Palembang City Land Office in case of overlapping certificates, and the concept of legal protection for electronic certificate holders regarding the security of personal data. This research uses the normative legal research method with a legislative approach, conceptual approach, case approach, comparative legal approach, and futuristic approach. Based on the results of this research, the author concludes that internal implementation obstacles are caused by the readiness of human resources (HR), infrastructure readiness, and data validation, while external implementation of electronic certificates in the region is hindered by limited access to information technology. The Palembang City Land Office implements provisions in accordance with applicable laws and regulations in both administrative courts and district courts. The Palembang City Land Office accommodates cases where legal products are deemed administratively and/or juridically defective, allowing the office to annul legal products without a court decision. Additionally, in the event of data breaches, legal responsibility primarily lies with the electronic system manager, in this case, the Ministry of ATR/BPN as the data controller.
